Uttar Pradesh Chief Minister Mayawati on Thursday accused the Ministry of Environment and Forests (MoEF) of deliberately delaying environmental clearance of her 33.43 hectare `dream' Noida Park Memorial project.
A day before the Supreme Court's Green Bench led by Chief Justice of India SH Kapadia is to hear the Noida Park matter, Mayawati's application in Supreme Court on Thursday criticised the ministry's affidavit filed on July 20 seeking more time to conduct an "integrated and holistic" environment impact assessment of the project. The MoEF's stand had come as quite a shock because the same ministry, on October 21, 2009, had concluded before the court that the Noida project was much below the "threshold limit" required for its environmental clearance. In the July 20 affidavit, the MoEF did a U-turn, saying environment impact of the Noida project was indeed "grave" and of a "complex nature". The ministry, through its lawyer Harris Beeran, informed that though the MoEF's Expert Appraisal Committee (EAC) reviewed various expert reports at a meeting on June 28-29, more time is needed to "arrive at a final and conclusive decision" on the fate of the project. Mayawati accused the Centre of deliberately not disclosing the minutes of the EAC meeting -- at which, she claims, the expert panel "considered all aspects of the matter, and thereby obviates the need for any further grant of time".
"The EAC's minutes of meeting have not been brought on record and this does not appear to be bonafide, constraining the state government to file this application," stated the UP government. Mayawati said the EAC's views for environmental safeguards was "acceptable" by both the state and the NOIDA Authority. "Centre has taken a conflicting and contradictory stand. We warily realise that the Centre seeking more time may even result in seriously affecting the project, especially in the likelihood of heavy rains," the state's application said. "It s unfortunate that the finishing steps for the Noida project before the Commonwealth Games should be subverted by the Centre's request for an open-ended enquiry. That too, when the enquiry was brought to a conclusion by the deliberations of the EAC," the application said.
